3. Accuracy of Product Information and Pricing

All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We strive to provide the most accurate representation of our items; however, we do not warrant that product descriptions, colors, or other content are error-free or complete. In the event of a typographical error or inaccurate pricing, we reserve the right to cancel any orders placed for that item. All prices are listed in Canadian Dollars (CAD).

4. Order Acceptance and Payment

The receipt of an order confirmation does not constitute our acceptance of an order or an offer to sell. We reserve the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any customer. Verification of information may be required prior to the acceptance of an order. All payments must be received in full before an order is processed for shipping or local pickup.

5. Shipping and Delivery Conditions

Shipping is available to select regions within Canada. While Hardware District provides estimated delivery timelines as a courtesy, these dates are not guaranteed and are subject to third-party logistics and external variables. Hardware District is not liable for any delays in delivery beyond our reasonable control. Customers are responsible for providing accurate shipping addresses and ensuring the delivery environment is safe and accessible for transport carriers.

6. Return and Refund Policy

To ensure the highest level of quality control and product integrity, our return policy is strictly limited to items in their original, unopened boxes. To be eligible for a return, the factory seal must be intact and the packaging must be in the same condition as received.

Once a product box has been opened, the item is no longer eligible for return, exchange, or refund. This policy allows us to guarantee that every customer receives a pristine product that has never been assembled or handled outside of our facilities. We strongly recommend that customers visit our showrooms in Vancouver, Calgary, and Toronto to inspect our collections in person prior to finalizing a purchase.

7. Limitation of Liability

In no case shall Hardware District, our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind, including, without limitation lost profits, lost revenue, or replacement costs, arising from your use of any of the service or any products procured using the service. Our total liability shall not exceed the purchase price paid for the specific product giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Hardware District and our parent, subsidiaries, partners, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third-party.

9. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service; such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
